Terms of Use

Last updated: 28 June 2026

1. Agreement to these Terms

These Terms of Use govern access to and use of the Evidenso website, platform, outputs, APIs, and related services.

By accessing or using the services, you agree to these Terms. If you use the services on behalf of an organisation, you represent that you have authority to bind that organisation. If you have a separate signed agreement, order form, or statement of work with Evidenso, that agreement controls where it conflicts with these Terms.

2. The service

Evidenso helps teams turn market, customer, and product context into analysis, recommendations, and related outputs. Outputs are decision-support materials and should be reviewed before use.

3. Accounts and authorised users

  • You are responsible for keeping account credentials confidential.
  • You are responsible for activity under accounts and workspaces you control.
  • You must provide accurate account and billing information where required.
  • You should notify Evidenso promptly if you become aware of unauthorised access or a security issue affecting your account.

4. Acceptable use

You must use the services lawfully and responsibly. You must not:

  • Use the services for unlawful, harmful, abusive, deceptive, or infringing activity.
  • Attempt to gain unauthorised access to the services or related systems.
  • Interfere with, overload, scrape, copy, reverse engineer, or disrupt the services except as expressly allowed in writing.
  • Upload malware, harmful code, or content that you do not have the right to use.
  • Use outputs as the sole basis for decisions that have legal or similarly significant effects on individuals, including employment, credit, healthcare, law enforcement, or eligibility decisions, unless expressly agreed in writing with appropriate safeguards.

5. Customer data and confidentiality

Customer-provided content remains the customer’s data. Evidenso may process customer data as needed to provide the services, operate customer-specific workflows and outputs, debug and secure the services, and provide support.

Customer-provided content is treated as confidential customer data. Access is limited to people and systems that need it to provide the services and are subject to confidentiality obligations.

You are responsible for ensuring that you have the rights and permissions needed to submit customer data to the services.

6. Outputs and product improvement

The services may produce outputs that are incomplete, inaccurate, or non-deterministic. You are responsible for reviewing outputs and deciding how to use them.

Customer content is not used to train third-party foundation models. Evidenso does not use identifiable customer data or customer confidential information to train general-purpose models.

Evidenso may use aggregated, de-identified learnings to improve product functionality, workflows, taxonomies, prompts, evaluation methods, and output quality, provided no customer data is identifiable and no customer confidential information is disclosed.

7. Third-party services

The services may depend on third-party providers, including infrastructure, analytics, support, and AI service providers. Evidenso is not responsible for third-party products or services that are not controlled by Evidenso.

8. Data protection

Personal data is handled as described in Evidenso’s Privacy Notice and any applicable data processing agreement or written customer agreement.

9. Security

Evidenso maintains reasonable technical and organisational measures designed to protect customer data.

Security controls evolve over time and may vary by plan, deployment, and written agreement.

10. Deletion and retention

Deletion and retention are handled as described in Evidenso’s Privacy Notice and any applicable written customer agreement.

11. Intellectual property

Evidenso and its licensors own the services, software, models, systems, designs, workflows, and underlying technology. No rights are transferred except for the limited right to use the services under these Terms.

Subject to these Terms and any applicable payment obligations, customers may use outputs generated through the services for lawful business purposes. Evidenso does not claim ownership of customer data.

12. Fees and commercial terms

Fees, subscriptions, quotas, renewals, cancellation rights, and payment terms may be set out in an order form, statement of work, subscription plan, invoice, or other written agreement. If no paid arrangement applies, Evidenso may limit, suspend, or discontinue free or trial access at any time.

13. Suspension and termination

Evidenso may suspend or terminate access if you breach these Terms, create a security or legal risk, fail to pay amounts due, or use the services in a way that may harm Evidenso, other customers, or third parties. Where reasonable, Evidenso will try to provide notice before or promptly after suspension.

14. Disclaimers

The services are provided on an as available basis. To the fullest extent permitted by law, Evidenso disclaims all warranties, including warranties of accuracy, reliability, availability, fitness for a particular purpose, and non-infringement.

Evidenso does not warrant that the services will be uninterrupted, error-free, secure, or that outputs will be accurate or suitable for any particular use.

15. Limitation of liability

To the fullest extent permitted by law, Evidenso will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.

Evidenso’s total liability arising out of or relating to the services is limited to the amounts paid to Evidenso for the services in the 12 months before the claim, or £100 if no fees were paid. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Incident notification

Security and privacy incident notification obligations are handled as described in Evidenso’s Privacy Notice, any applicable data processing agreement, and any written customer agreement.

17. Changes to these Terms

Evidenso may update these Terms from time to time. The updated version will be posted on this page. Continued use of the services after an update means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, unless applicable law requires otherwise.

19. Contact

Questions about these Terms can be sent using the contact details made available through the Evidenso website or service.
